Commercial Lead

Main responsibilities and key outcomes:

1. Key advisor to Commercial Director on all project commercial and/or contractual matters.
2. Provide advice to the Project Management team on the day to day commercial risks and associated issues that arise during the cycle of the project.
3. Negotiate with stakeholders on new Contracts and amendments to Contracts to ensure equitable and balanced business relationships can be formed without undue risk to the Company.
4. Maximise company entitlement with respect to profitability and/or revenue and mitigat and minimise expenditure.
5. Maintain a strong cash flow into the business by tracking and monitoring application, certification and invoices.
6. Ensure compliance with Company commercial and/or contracts policies and or procedures.

Key Responsibilities:

Manage, lead and mentor a team of Quantity Surveyors, whilst maintaining high standards and clear objectives.
Maintain standard operating procedures in line with Company policies and provide input into the continuous improvement and development of such procedures.                                                                                                                                                                                        Ensure the delivery of robust financial governance and lead on matters related to commercial, performance reporting and contracts management.
Prepare monthly budgets and forecasts, cash flow and/or cost value reconciliation reports detailing P&L against forecast.
Implement project commercial and contract strategies and provide guidance to Project teams with respect to cost control, contract administration and/or risk management.
Review Invitation to Bid (ITB) documents and perform quantitative analysis of construction documents and project programme requirements for commercial viability and application of risk management, with particular emphasis on indemnification and
limitation of liability.
Individual tender and project review procedures starting at divisional levels, progressing to Tender Board Committee if value, or perceived exposure, exceeds certain thresholds.
Manage the monitoring of, and reporting on, strategic and operational risks and related key controls to ensure risk management across all projects.
Review and approve data submitted by staff for business development proposals.
Provide indirect support for proposals, strategic plans, presentations and contract negotiations. Participate in final pricing of proposals by providing counsel and information pertaining to the financial and contractual aspects of the project.
Key advisor in the negotiations of new Contracts and amendments to Contracts to ensure equitable and balanced business relationships can be formed without undue risk to the Company and prepare all requisite documentation for legal counsel review and
agreements.
Ensure that all Sub-contractors and Suppliers are procured and pre-qualified in accordance with Company procedures.                        Drafting and Issuing Letters of Intent and contractual correspondence.
Ensure that all project specific contract obligations are monitored, administered and issued are regular intervals or as defined within the Head Contract and Sub-contract.
Negotiate and agree wording and limits or levels of security in respect to Performance bonds, Parent Company Guarantees, Insurances, etc. and review and monitor document renewals where applicable.
Proactively manage individual’s claims from notification to closure including engaging with external third parties, where necessary, depending on, inter alia, the nature, category, type and quantum of the claim.
Timely review of Contractors and Supplier payment certificates and prepare recommendations for payment.
Validate, submit and negotiate final account applications and recommend Contractor or Sub-contractor final accounts including monthly review of supporting contemporary records.
Chair meetings with project management staff providing guidance with respect to commercial best practice, ensuring that all projects costs are fully reconcilable and auditable for demonstration to the Executive team or external auditors.
Manage allocation of staff resources and identify recruitment needs to meet both current and anticipated workload.
Attend internal or external progress and commercial meetings with client or interfacing parties.

Educational Qualification Required: (minimum) , Degree Qualified or Qualified by Extensive Experience. BSc Hons Quantity Surveying, Experience on high value projects.

Previous Work Experience Required: Experience in setting up commercial management and reporting systems
